Felon Settles Case With Insurance Company For $300,000

Felon Settles Case With Insurance Company For $300,000

Posted By The Dunnion Law Firm || 15-Jun-2012

A 23 year old construction worker with two felony charges received $300,000 for injuries he sustained in a motor vehicle accident. The 23 year old was riding as a passenger in a car going to work in January of 2009 when the vehicle in which he was riding was struck from behind by a truck. The truck driver claimed that he did not see the car and this it did not have visible lights in the early morning fog. The 23 year old was taken from the scene by ambulance to the local emergency room where he was treated and released. His back without treatment continued to both him. He reported the claim to the truck’s insurance company and was advised they would pay his $1,650.54 hospital bill. Not satisfied he contacted The Dunnion Law firm. Their the attorney decided that the medical evidence and treatment were not adequate. The 23 year old was referred to an orthopedist who ordered a bone scan. The scan disclosed an previously undiscovered compression fracture at T-7. The fracture was healed and the 23 year old was deemed not to need surgery. The Dunnion Law Firm attorney argued that the young man would have pain to some degree for many years. A defense attorney hired by the trucks insurance company discovered the two felony charges against the 23 year old for accessory to burglary and false statement on a BATFE (Bureau of Alcohol Tobacco Firearms & Explosives) form for the purchase of a hand gun. The Dunnion attorney contacted the 23 year old’s public defender in the felony matters and a petition to reduce the charges was filed by the public defender. Thus counsel for the truck company was left floundering for a viable trial defense and agreed to mediation. The Dunnion Law Firm presented its evidence to the mediator pointing out that the felony charges would likely not come before the court on Civil trial. Ultimately, after two days of mediation the insurance company for the truck capitulated to the demands presented and agreed to settle the 23 year old’s claim for $300,000.00. The young man noted that though the process took time and considerable effort $300,000.00 is a significant over the offer he received of $1,650.54 before he hired The Dunnion Law Firm.
