Decedent a 53 year old father of two adult children was killed when he tried to ride his bicycle across a busy Tulare street.. He was a daily bicycle rider as he had no driver’s license. He had not worked in three years and was an alcoholic and diabetic heart patient. On the day of the accident he was taking 13 different medications. He would sometimes become almost lethargic. Unfortunately, on the day in question no one knows why he rode his bicycle directly in front of a car. His children did not know what to do and called the Dunnion Law Firm. They knew the police blamed their father. The knew the insurance company for the car driver denied the claim. Nonetheless, they were saddened by the loss and ask The Dunnion Law Firm for help. The Dunnion attorney assigned to the case argued for comparative negligence on the car driver for not slowing when he saw the bicycle in the road. The insurance carrier denied liability but agreed to settle for their insured’s $50,000.00 policy limit rather than face the Dunnion Law Firm in court. The children were grateful and admittedly did not expect a recovery.
