In February 2012, an east bay resident driving her convertible Mazda Miata was rearended by a large SUV and pushed ahead into a Dodge Ram pick up truck. The Miata was crushed. The driver of the SUV tried to blame the woman for the accident claiming the brake lights on the Miata were not working. The lights were working, however, and the accident was caused by the SUV drivers inattention, pure and simple.
The woman was taken by ambulance to the emergency room where she was treated and released. She worked as a nurse so she talked to the doctors where she worked and they recommended she see a specialist as she was experiencing post concussion symptoms as well as radiating pain in her arms and legs.
The inattentive man did not have enough insurance so the woman had to collect from her own insurance carrier for her injuries using her underinsured motorist coverage.
