Motorcycle Rider Accused of Riding on the Wrong Side Prevails Against Automobile Driver

Posted By The Dunnion Law Firm || 13-Aug-2014

A 55 year old motorcycle mechanic was riding his Yamaha Warrior 1700 home from work in rural Madera. The conditions were dark and clear at 6:25 p.m. as the rider approached Ave 22 just East of Elmwood Road. He saw a pick up truck pull into the roadway and make a right turn. Recognizing that the truck was too close for him to safely stop he moved from the East bound lane of Ave 22 to the West bound lane. He was now according to the subsequent police report on the wrong side of the road when the pick up made a left turn attempting to enter a drive way. He was now completely blocked with no where to go and on the wrong side of the road. He nailed the brakes hard pulling the front brake lever to the bar. The Yamaha skidded before impacting the left side driver’s door of the pick up. He fell to the ground injuring his right wrist. The police arrived and after investigation found the motorcycle rider at fault. Upon release from the hospital he contacted the pick up owner’s insurance company and for the first time was told he would not be compensated for his hospital emergency room bill as he was at fault. Frustrated he called The Dunnion Law Firm. An experienced motorcycle attorney in The Dunnion Law Firm was assigned. He quickly noted that the motorcycle rider had some comparative fault but was not the sole cause of the accident and his claim should not be denied. The Dunnion Law Firm attorney hired and accident reconstruction expert to prove that the only reason the rider was on the wrong side of the road was because the pick up had violated his right of way not once but twice. First when he entered the road way causing the motorcycle rider to move to his left then again when he turned left to the private drive way. As a result of this analysis the pick up driver’s insurance company agreed to settle without litigation. Through negotiations they made several offers culminating in settlement in the amount of $130,00.00 . A sum well over the amount of the emergency room bill the rider wanted paid. He was not greedy and was compensated for his bills, lost income and general pain. If you are ever injured while riding you too should call The Dunnion Law Firm. They will gladly give you a free consultation.
