The client was hit while walking through a crosswalk; he sustained soft tissue injuries and was released from the emergency room with no significant treatment and a diagnosis of "low back pain." He called the firm the next day and we agreed to represent him. Unfortunately, the client presented with a series of problems that made it difficult to get full value for his claim: homeless, drug addicted, mentally ill, felon who had served time, 150 pounds overweight, and no medical insurance of any kind. The firm had to walk the tightrope between getting the client the medical treatment he needed and settling the case without revealing the unfavorable aspects of the client’s situation. Fortunately we were able to work with several doctors, therapists, and surgeons, who treated the client while agreeing to wait until the end for payment. Then, just days before the lawsuit had to be served on the other side, which would have enabled the insurance company to learn more about their client, Dunnion was able to secure a very favorable settlement–$85,000–which will pay the bills and still pay out to the client what he had demanded as a condition of signing the settlement documents.
