The client broke her arm when she slammed her Camry into a big rig in the middle of the road. The parties sharply contested how the accident happened. It was a dark country road; the big rig was pulling out of a driveway, trying to get straightened in the lane, when the Camry came along. The client did not see the rig until it was too late to stop safely, although she was able to slow enough to save her life by not driving directly under the trailer. Even after written discovery and taking depositions, the parties were unable to agree on exactly how the accident happened, where it happened, and whose fault the accident was. Since the risk of going to trial was clear for both sides, the parties agreed to try to settle the dispute though mediation, which was successful. The client is very happy as she will be able to pay her attorney fees and costs, pay her medical bills, pay the bills she accumulated when she could not work, and still have a significant cash reserve for her own use.
