Dunnion’s client was parked at the curb when a passing garbage truck lost control of its pick-up arm which crashed down into client’s truck bed then dragged the truck several feet down the road. Somehow, the client emerged with an injured wrist. It was eventually discovered that he had fractured a bone in his wrist, had to have it surgically repaired, and was months in recovery before he could return to his regular work as the owner/operator of a construction company. While the garbage truck admitted it was liable for the accident, it also protested that he client had injured his wrist earlier (he had) and there had already been a suspected fracture at that time, Further, the company argued that due to the general turndown in the construction industry at the time of this accident, the client’s losses were much smaller than alleged. This would leave been an expensive case for both sides to try as both sides would have had to hire expensive experts to prove their allegations. Instead, the parties agreed to meet before getting into expensive litigation to se if they could come to an agreement. In this case, both parties came out ahead as they were able to avoid tens of thousands of dollars in litigation expenses and another year before getting to trial.
