A Merced woman was bicycling through an intersection when she was struck by the defendant’s lifted pickup truck. She was knocked to the ground and ended up under the vehicle, but was able to crawl out from under it. When she did, she realized she was bleeding profusely from her foot, and would go on to suffer scarring across the top of her foot. Complicating matters was that the woman was not following applicable bicycle laws when crossing the street, not wearing a helmet, and routinely failed to attend subsequent doctors appointments.
The Defendant did not make a pre-litigation settlement offer.
