School Administrator Collects Policy Limits

A 47 year old high school administrator was driving in rural Fresno County when a vehicle, driving in the opposite direction, attempted to make a left turn into a parking lot. Substantial crash with air bag deployment. Initially, the school administrator tried to handle the claim on her own but soon became frustrated with the road blocks thrown out up the defendant’s insurance carrier. She then hired the Dunnion Law Firm and explained her situation. While the impact was significant, the insurance carrier could not understand how she injured her hand. The Dunnion Law Firm retained experts who were able to explain that her hand was damaged by the deploying air bag and that the injury was a very unique injury. A hand surgeon was retained who described a "bossing" of the metacarpal which required surgery. Armed with the medical evidence, The Dunnion Law Firm made a demand against the defendant’s public liability policy limits in the amount of $30,000.00 which they now tendered. The Dunnion Law Firm also presented a claim for underinsured motorist coverage, which was also tendered in light of the well prepared and well documented evidence. The ultimate settlement, which included the needed hand surgery, was in the amount of $100,000.00. The surgery was paid for by the school administrator’s ERISA insurance plan. The Dunnion Law Firm negotiated the plan’s subrogation interest for the school administrator as well.
