City Garbage Truck Hits Bicyclist and Refuses to Accept Fault

A Kings County woman was bicycling to her new job one bright and clear morning. She had only left home a few minutes before. But like most accidents, what happened to this bicyclist happened very close to home. She saw a city garbage truck parked along the shoulder of the road. She planned on passing it on its left side as it stayed parked. Most garbage trucks have rear-facing cameras, so the driver should have seen her behind him. He did not check for approaching traffic and the driver made a sudden U-turn as the woman was passing him. She hit the side of his truck and fell to the ground, seriously injuring her leg. For nearly a year, she dealt with leg pain. During that long painful year, she also had to deal with a city government that refused to take any fault, despite a favorable police report. She hired The Dunnion Law Firm who quickly filed the lawsuit, suing the city for its negligent driver. The city never accepted fault, pointing out that the woman should have seen the turn signal activated and yielded to their driver. This was a ridiculous argument that Dunnion soon used to great effect in litigating against the city.
