Tomato Truck Mess Results in $650,000 Settlement

Dunnion’s client had quite a scare. As he was driving down Pacheco Pass into Santa Clara County at 4 am, on his way to his job at Soledad Prison, the tractor of a tomato truck ahead of him overturned, spilling tomatoes in a thousand foot swath down the highway. Our client said it was like driving on an ice rink and as he approached the disabled trailer, he thought he was a dead man. Although he survived, he ended up with a three-level fusion in the low back, and it looked for a time as though his career would be derailed as well. He did manage to transfer to another prison job that was not as strenuous, but he remains in pain and had to curtail many activities. Just weeks before a trial date was to be assigned, the claim settled at mediation with a payment of $650,000
