On January 29, 2014, a seventeen year old youth was asked by his seventeen year old friend if he wanted to go for a ride in the friend’s old Chevy crew cab pick up. He agreed. Shortly into the ride the boys stopped and consumed some beer and realized it was now 2 AM. The driver, on a restricted license, reportedly saw a three hundred pound wild boar appear in the roadway. The driver swerved to avoid the boar, and then over corrected losing control. The pick up finally came to rest slammed up against a three ton boulder. The seventeen year old suffered serious injury to his right leg that required transport to the hospital and surgery. He reported the matter to his insurance carrier who advised him that he would have to seek any medical payments from the driver’s policy. Unfortunately the driver only had $5,000.00 in medical payments available. Frustrated, the seventeen year old contacted The Dunnion Law Firm, wherein the Dunnion attorneys assessed the situation and determined that the driver was at fault for the accident and was liable. The driver carried a liability policy in the amount of $50,000.00 in addition to the $5,000.00 in medical payments which were both collected. Further investigation revealed that the seventeen year old did have an additional policy in his parent’s name that offered $25,000.00 in medical payments coverage on top of that received from the driver’s policy. Not withstanding the strong resistance by the seventeen year olds’ father’s insurance company, they relented and paid the $25,000.00 in medical payments. The Dunnion Law Firm argued that the seventeen year old was not made whole and should retain all funds and not be required to reimburse any portion of the medical payments received. As a result of The Dunnion Law Firm’s familiarity with insurance policies the matter settled for a gross sum of $80,000.00.
