Plaintiff, a 70 year old senior citizen, was riding as a backseat passenger in her friend’s vehicle on Highway 43 and Orange Avenue in the city of Corcoran. They were just returning home from a brief trip when things changed dramatically. Her friend stopped at the intersection of Orange Avenue and Highway 43. They were proceeding west on Orange Avenue. After stopping, her friend proceeded onto Highway 43 when they were struck by a speeding vehicle. The senior passenger made a claim against the adverse party’s insurance as she was sure her friend had done nothing wrong. Unfortunately, the investigating police officer saw it otherwise and stated that her friend had entered the roadway in violation of California Vehicle Code Section 21801(a) which only allows vehicles to enter the roadway when there is no other vehicle close enough to constitute a hazard. At this point, the senior contacted The Dunnion Law Firm and the attorney for The Dunnion Law Firm took on the task of explaining the reason her friend had insurance was for just such occasions. She allowed The Dunnion attorney to proceed with the claim which ultimately resulted in a policy limits settlement of $100,000.00. In addition, The Dunnion Law Firm attorneys collected an additional $25,000.00 from her friend’s medical payments coverage as well as $5,000.00 from her own personal policy. She was surprised by the result and pleased that The Dunnion Law Firm was able to explain the situation such that she was able to remain friends with her driver on that faithful day.
