Woman Recovers From Deceased Driver's Insurance Carrier.

A 49 year old San Jose woman had driven to Gilroy, California, to shop for a new vehicle. After she had perused a number of car lots she was ready to return home at approximately 2:30 in the afternoon. She proceeded out of Gilroy, California, Eastbound on O’Farrell Avenue. She approached the traffic light, which had turned to a green arrow in her direction. She had a vehicle along side of her and started to turn through the intersections left onto Monterey Road. Suddenly, an 85 year old woman operating a silver Chevrolet Malibu Southbound on Monterey Road in the number 1 lane, ran the red light striking one of the left turning vehicles and pushing it into the 49 year old woman’s car. She was injured at the scene, fortunately not seriously. She was transported by ambulance to the hospital where she was treated and released. She then attempted to negotiate with the adverse party’s insurance carrier, but was predictably rebuffed. She was told that the 85 year old had passed away. At this point the 49 year old woman contacted the Dunnion Law Firm and engaged an attorney to protect her rights. A lawsuit was filed against the 85 year old woman’s insurance company as she had no estate. The matter proceeded forward in litigation and was ultimately mediated by Williams and Williams Mediation Services in San Jose, California. Due to the diligent research and preparation by her team at the Dunnion Law Firm the net result of the mediation was a recovery for the 49 year old woman of $70,000. She said that she would be using this money to finally purchase the new car she was shopping for on the date of her accident. She was surprised that the adverse party’s insurance carrier put up so much resistance prior to her hiring the Dunnion Law Firm and reaching the justifiable result in mediation.
