Our client’s adult daughter was killed when she was hit by a truck while walking her bicycle on a country road outside Merced. She had been staying in Yosemite and had biked through town earlier that day, but it was late at night and she was heading back to town. The driver that hit her was in a commercial truck and may have been inattentive and speeding. The CHP blamed our client for wearing dark clothing, having no lights and concluded she caused the accident as there was nothing the truck driver could do because he did not, and could not, see her until the last second. Our client, who lived in the Bay Area, hired The Dunnion Law Firm to help her when nobody else would due to the very difficult facts and circumstances of the case.

We hired experts to analyze the accident and formulated a theory that the driver was traveling at least 60 mph (in a 55 mph zone) and more likely about 73 mph based on the fact that it took him a few hundred feet to stop after the crash, and the fact that our client’s daughter suffered major internal injuries and died instantly. We made a demand to settle and the insurance company offered zero so we filed suit. Once the lawsuit was served, the head attorney for the insurance company quickly agreed to an early mediation, where the matter resolved favorably despite the insurance company insisting their driver did nothing wrong. In fact, at the mediation, the insurance company’s attorney personally apologized to our client for her loss upon conclusion of the matter, and acknowledged the tremendous loss she had suffered as a result of the accident.

More importantly, our client and her extended family were protected from the costs and risks of long, protracted litigation and will hopefully be able to turn a leaf in their lives and move on after this tragedy.
