Our client had a car accident in late 2013 in Bakersfield. As she was recovering from that case, she was hit again in May 2014 by a reckless uninsured driver who then tried to flee the accident scene. Bakersfield police arrested her and took her to jail. Unfortunately, our client suffered serious internal injuries and spent a week in the hospital. Thankfully, she made a full recovery but incurred significant medical bills. We were able to negotiate a $200,000 settlement for our client through her Uninsured Motorist (U.M.) policy. More importantly, we found a loophole in our client’s health insurance plan that did not allow for any reimbursement to them when the client made a U.M. claim. Thus, their demand for $30,000 for reimbursement for medical bills paid was fully waived, and our client was able to keep those funds for herself, too.
