Electricity is a modern day necessity. Everywhere you go everyone is plugged
in, on line, and staying in touch. We take electricity for granted.
The distribution and delivery of electricity is one of the most dangerous
activities that takes place as part of our every day lives. Because of
that, we rely upon those companies that deliver that electricity to us
to do so in a safe and reasonable manner. They are held to a high standard
of care because the risks involved with electricity are dramatic. When
one of those companies fails to safely maintain its distribution system,
it exposes all of us to the risk of life altering injuries.
Being in the wrong place at the wrong time was the beginning of a nightmare
of a Poplar resident caused by Southern California Edison Company’s
failure to safely maintain its distribution system.
When a power line broke and fell dangling from a power pole next to the
man’s business, the man went outside to explore what caused the
loud "explosion". Not knowing the power line was dangling dangerously
from the power pole and bouncing against a propane truck, the man walked
into a situation that nobody could be prepared for. As the man realized
what was going on, the power line touched the ground near him and the
electricity traveled through the ground into the man’s leg. According
to the emergency room doctor, the electricity traveled into his body through
one foot and came out the other.
The result was a small burn to the big toe on his right foot, with associated
pain and tingling. The injury did not seem too bad, but the man could
not envision at that time the nightmare he was just dragged into by the
negligence of this gigantic electricity company.
Edison was ready. Their investigator was on the scene telling the injured
man that Edison would not be responsible for his injuries because the
man was refusing to take an ambulance to the emergency room. The man is
the proprietor of a retail business and he had responsibilities. Obviously,
Edison’s sole concern was their own liability and not the well being
of a member of society that was obviously and severely harmed by its negligence.
Over the next three years, the man received medical care and was eventually
diagnosed with an unusual neurological condition called Complex Regional
Pain Syndrom. CRPS, sometimes called RSD or Reflex Sympathetic Dystrophy,
is a permanent and life changing condition in which a person’s body
feels pain in an area but the source of the pain is solely the result
of the disruption of pain signals being received by the brain. The effected
area does not have any actual physical injury that generates the pain.
The Dunnion Law Firm retained the best expert regarding this condition
and after three years of denial and refusal to accept responsibility,
faced with a trial only sixty days away, Edison finally acknowledged its
responsibility for this man’s plight by agreeing to pay the man
