While driving on Highway 24 in Martinez, California, our client, a 50 year
old man, was rear-ended at a high rate of speed by a 25 year old inattentive
female who was arguably on her cell phone, although not confirmed in the
Traffic Collision Report. The client’s injuries included a full
thickness tear in his right shoulder rotator cuff that had to be surgically
repaired. This diagnosis was not confirmed, however, until after the client
was involved in a second accident a mere 9 days after the first injuring
accident. Emergency room doctors diagnosed our client with a right shoulder
contusion the day after the injuring collision, but the rotator cuff tear
was not confirmed until approximately four months later. Needless to say
to avoid responsibility, the defendant’s insurance company argued
that the client’s surgical injuries were caused by the second collision.
