A 26 year old man was riding his bicycle in Santa Clara County on August
13, 2015, at approximately 9:30 a.m. As he was attempting to go northbound
on the Great Mall Parkway bike lane, traffic was stopped. He attempted
to "filter" between the vehicles to get to the middle divider.
Unfortunately, during his maneuver, he was struck by a Lexus automobile.
He suffered injuries to his neck, back and both knees. When he contacted
the adverse motorist insurance company, he was advised that he would not
be paid for his injuries or his bicycle because he was found to be the
at fault party. At that point he hired The Dunnion Law Firm to make his claim for him.
The Dunnion Law Firm attorney reviewed the police report and found that
indeed the investigating officer had found the claimant/bicyclist at fault
for violation of California Vehicle Code Section 21453(a), a red light
violation. The bicyclist denied the red light violation and asserted that
he was working his way through traffic to get to the bike lane. The Dunnion
Law Firm attorney analyzed the police report and made favorable arguments
on behalf of the bicyclist. When faced with the analysis, the insurance
carrier for the adverse driver agreed with The Dunnion Law Firm and offered
its full policy limits in the amount of $50,000.00.
