On May 30, 2015, a slightly overweight Hispanic individual was driving in rural Fresno County. At the same time, an individual of middle eastern decent failed to stop at an intersection and struck his vehicle. The injured man went to the hospital where he was checked out and released. Because he was not getting better, he contacted The Dunnion Law Firm where treatment was established with a local chiropractor. He treated for approximately three months with the chiropractor and still had complaints. The chiropractor related some of his complaints to pre-existing conditions and his moderate obesity. In order to confirm and validate his chiropractic treatment, The Dunnion Law Firm arranged for a medical examination by an orthopedic specialist. The orthopedic specialist reported that the treatment that he received through the chiropractor’s office was both reasonable and necessary. The orthopedist did not find that he needed any special orthopedic treatment and referred him back to the chiropractor for an additional three weeks. Upon completion of his treatment, The Dunnion Law Firm presented a demand to the insurance carrier for the adverse party who initially offered a minimal sum for his soft tissue injuries. Counsel for The Dunnion Law Firm insisted that this was more serious than that and that soft tissue injuries were nonetheless real and were painful. Confronted with this information, the insurance carrier for the adverse party eventually raised its offer to $50,000.00 and the case was settled.
