A Minor Injured in Rollover Accident.

An 11 year old San Joaquin Valley student sustained injuries to her right arm when her mother’s Chevy Tahoe SUV overturned. It was approximately 6:00 p.m. when the young woman came to her mother and pleaded with her to take her to a math tutorial being held at her school. Her mother was tired from a long day of work and really didn’t want to take her. She considered simply telling her daughter “no I am too tired.” However, with a child so exuberant and eager to advance her education, she relented. Unfortunately, the trip to the tutorial had tragic consequences as the mother’s SUV approached the intersection of Winton Way and Crawford Street, in Merced County, a woman operating a Chevrolet automobile and for reasons unknown, stopped in a private driveway on the east roadway edge of Winton Way. Suddenly, she exited the drive of Tequila Café and plowed into the side of the SUV, causing it to rollover onto the passenger side. Unfortunately, the young exuberant math student’s arm fell out the side of the vehicle and sustained serious injury. She was transported by ambulance to a hospital in Sacramento. Her mother was fortunately not seriously injured but was devastated over what happened to her daughter. She contacted defendant’s insurance carrier. They were initially unresponsive and would not accept the gravity of the situation. Facts were developed that showed that the defendant exited a private driveway at an excessive speed. It was inconclusive regarding her alcohol consumption. The Dunnion Law Firm attorney also hired an orthopedic expert to explain the injury to the young woman’s arm. Fortunately, she has regained full use of her right hand and is back at school. Faced with this evidence, the insurance company for the negligent driver paid over its full policy limits in the amount of $100,000.00. The mother’s case, which involved a Dillon v. Legg claim and a personal injury claim, also settled for the available policy limits of $100,000.00.
