On April 17, 2016, our client went out on a date a gentleman not realizing that he was intoxicated. They were traveling on SR 59 in Merced County California when, due to his intoxication, he was unable to negotiate a curve and rolled his vehicle over with our client, who was riding as a passenger, in his car. As the vehicle rolled through the northbound lanes of traffic, it collided with a tree and came to a rest on its right side with the roof crushed against the tree on the east shoulder. Emergency personnel had to be extricate the trapped couple from the vehicle with the jaws of life, because the car was lodged against the tree with the roof was crushed inward toward the passenger compartment, the fenders buckled, the hood dented, both drivers and passenger doors dented in with the mirrors detached, and the windshield broken. Our client, who was unconscious from a blow to the head including a large laceration to the right side of her head, was rushed to the emergency room. She was treated by emergency room doctors and then hospitalized for a little over a month for her traumatic brain injury, that left her unable to speak for some time. Meanwhile, at the scene, her date was arrested for driving under the influence after investigating officers determined that he smelled of alcohol, found an empty bottle of Cazadores Tequila near the crash site, and located a baggy containing a green leafy substance resembling marijuana lying on the right front floorboard of the vehicle. Although the Traffic Collision Report stated that her date had no insurance, The Dunnion Law Firm was able to uncover insurance on the vehicle and obtain the policy limits of $100,000 for our client within a short period of time.
