Our client, a lifelong Stockton resident, was a passenger driving home from work with his coworkers on Interstate 5. His driver stopped for rush hour traffic when, without warning, an out-of-state semi truck driver slammed into their stopped vehicle and caused a multi-car pileup. Our client suffered serious injuries to his neck, back and shoulder, and was transported by ambulance to Dameron Hospital. He saw his regular doctor within a few days and was referred for medical care for his injuries. He underwent some chiropractic care in town but his symptoms did not resolve, and he was referred for MRIs. Unfortunately, it was discovered he had sustained a rotator cuff injury and he underwent shoulder surgery. He recovered somewhat but continued to have neck and back pain, and underwent epidural injections on his spine, too.
We filed suit on behalf of our client for his injury claim and his wife for her loss of consortium, and we prosecuted the matter aggressively enough that the insurance company for the semi truck was desperate to attend mediation and settle the case. We had a hearing in San Francisco and presented significant evidence of our client’s injuries to the defense attorney and insurance representative, who had flown out from Idaho due to the seriousness of the case. At the end of the day, our client and his wife were thrilled to receive $250K to resolve their cases.
