Our client was on a bicycle weaving through stopped traffic when he collided with an off duty Sheriff in Antioch. He sustained serious injuries including a brain hemorrhage and comminuted zygomatic facial fractures. He was airlifted to John Muir Medical Center and was admitted to the trauma center and he underwent multiple surgeries. The police report and independent witnesses fully blamed our client, though, and the sheriff’s insurance company denied the claim initially before our involvement. Our client’s medical records showed he may have been intoxicated, but we took this challenging case because he was seriously injured and it was unfair to fully blame our client for the accident because the driver was admittedly speeding.
It took over a year of investigation and fighting with the other side, and filing a lawsuit against the driver, before his insurance company took us seriously. When they did, not only did they pay their entire underlying policy limits, but also additional funds from his umbrella policy to get the matter resolved. Our client’s medical bills were reduced significantly due to Medi-Cal payments, and we then negotiated a 75% reduction of the total due to Medi-Cal, leaving a large portion to our client to compensate him. Our client was happy with the results and the fact that he did not have to go to court on his case.
