Our client was a passenger in a vehicle driven by her god-daughter. They were in Bakersfield and stopped in traffic when a box truck slammed them from behind causing them serious injuries. Our client was shaken up and taken to the hospital. She followed up with her regular doctor and underwent a course of physical therapy. She underwent an MRI because her symptoms would not subside, and an MRI of her shoulder revealed a rotator cuff injury. Due to other unrelated medical issues, she could not have shoulder surgery. Because of this, the truck’s insurance company refused to pay her for her injuries. However, we were able to secure enough medical documentation to convince the truck’s insurer to compensate our client for her pain and suffering despite not having surgery. We also set up her settlement so that her health insurer was to pay for the future surgery without costing our client money out of her pocket. She was very happy to settle her case and receive her funds, and we wish her the best of luck with her recovery.
