Our client came to us with a difficult case. A woman had struck him while he was riding his bicycle and he had suffered a fractured spine. Unfortunately, the police report placed our client 100% at fault based on an independent witness who said our client rode his bicycle directly into the path of the woman’s van. There was also evidence that our client was under the influence of alcohol.
We took a hard look at the facts in order to determine whether or not the woman had any responsibility for causing the crash. We work extensively with many accident reconstruction experts and understand the techniques that they use to analyze a collision. In this case, we looked at the visibility conditions, the distance the bicyclist traveled in front of the defendant’s vehicle, and the defendant’s stopping distance based on the maximum speed limit and typical human perception and reaction time. We were able to show the insurance company that the defendant should have been able to stop in time to avoid the crash if she has been paying attention and driving the speed limit.
Based on our accident reconstruction analysis and the severity of our client’s injuries, we convinced the insurance company to pay the $100,000 policy limits without having to file a lawsuit.
