$250,000 Policy Limits Settlement for Disputed Liability Case
Posted By The Dunnion Law Firm
On a Sunday in October at 7:30 p.m., our client, a 59 year old unlicensed driver, was traveling northbound on State Route 25 in an unincorporated part of San Benito County, California. As she was making a left hand turn to go to her son’s house, she was struck by an oncoming vehicle. She sustained major injuries, including a closed head injury with traumatic subarachnoid hemorrhage, bilateral humerus fractures (both arms), multiple rib fractures, pulmonary contusion, and a right scapula fracture, and acute blood loss. A helicopter air ambulance rushed her to San Jose Regional Hospital, where she had to be resuscitated upon arrival. She was admitted to intensive care after they performed emergency surgery. The other driver’s insurance company denied her claim based upon an unfavorable police report that blamed our client for making an unsafe left hand turn. The Dunnion Law Firm obtained a favorable settlement by hiring an accident reconstruction specialist who determined that their client was speeding.
