Our client was driving with the right of way in Salinas. Another driver pulled out and caused a serious accident which totaled both vehicles. Our client was taken to the local hospital where it was determined she may have a serious head injury, so she was transported via ambulance to a medical center in San Jose. We took the case not knowing who was at fault nor whether there even was a source of funds from which to obtain a recovery for our client.
We investigated the case, and obtained the police report which blamed the other driver. The other driver’s insurance company, however, made two factual claims: First, that our client was speeding, and second, that our client should have avoided the accident. Because the insurance company sought to blame our client despite the contrary findings of the investigating police officers, we filed suit and conducted extensive discovery. Deep into litigation, and after taking our client’s deposition, the insurance company tendered their policy limits. We fought hard to get our client compensation she deserved, and negotiated her medical bills down so that she could receive even more of the insurance funds as compensation for his injuries.
