Father and Son Injured When Their Loaded Tow Truck and Trailer are Overturned

The clients, tow truck operators, were driving with fully loaded truck and trailer when they were broadsided by a Ford 350 which had failed to stop for a stop sign. Their tractor flipped over, scattering cars and car parts all over the road, and landing the Dunnion clients upside down in an unstable sand bank by the side of a vineyard. The father was unconscious, trapped in the driver’s seat and bleeding. The son was upside down, with cuts all over his body, and terrified for their lives. He could feel them sinking into the sand and he could hear the metal of the cab creaking as it slowly bore down on them–like some bad movie. He scrambled to get out the crushed window on the passenger side. The driver’s side was so beat down that it would be impossible to get his father out that way and he worked to drag him out through the passenger side. Fortunately both were able to get out and escaped with cuts, bruises, and sore muscles. The Ford operator told the police that his brakes failed unexpectedly, and this was confirmed by the officer. The insurance carrier for the Ford did not want to pay for what they felt was an unforseen event, but the Dunnion Law Firm took the case anyway and was able to convince the carrier to pay a fair amount for their clients. The case settled for a combined $120,000.00.
