This was a case in which our client, an adult student in the U.S. and a former international attorney, was parked by the beach sitting in his vehicle reading and having lunch in between classes. Suddenly, and without warning, he heard a loud truck behind him, barely had time to look, and saw a school district vehicle coming right at him. He was slammed from behind and struck the parked car in front of him. Apparently, the other driver had fallen asleep at the wheel, literally.
Our client was transported by ambulance straight to the emergency room and diagnosed with a concussion, neck and back injuries. A few days later, he developed blood in his urine and was again transported by ambulance to the hospital. Over the next two years, he underwent treatment with an M.D., underwent physical therapy, had MRI's of his back, tried chiropractic, saw an orthopedic surgeon, and was referred to a neurologist/pain management specialist. He made a significant recovery without the need for surgery, and although the school district's doctor did not think any treatment was needed after the first hospital visit, and did not even think the second visit was related to this accident which broke his driver's car seat.
After two mediations, the matter settled for six figures on the morning of the settlement conference.
If you have a serious injury claim against a school district or other public entity, you need experienced
personal injury attorney who know how to negotiate through the convoluted Government Code, which of course protects the entities and not the victims,
and who can litigate against the public entity, their army of attorneys, and their huge budget which they set aside to fight victims such as our client. Whether it is a local, county, state or federal governmental agency, The Dunnion Law Firm is not afraid of making and fighting these claims, and routinely obtains justice for our clients.
