The Plaintiff was riding his motorcycle in the Santa Cruz mountains. He had no license and no insurance. An elderly man pulled out from a stop sign and struck the plaintiff causing him to be thrown from the motorcycle and sustain serious injuries. He was airlifted to Stanford.
Although the police found the other driver at fault, the other side's insurance refused to pay our client claiming he was at fault for speeding, his motorcycle brakes were faulty, and that he was drunk because he was arrested at the hospital due to the fact that he smelled of alcohol. The truth of the matter, as later proven, was that he had he had been returning home from the store with a just purchased unopened bottle of alcohol in his backpack which shattered from the accident. He was not under the influence.
Our client was rejected by numerous attorneys until he called The Dunnion Law Firm, who fought for his rights and was able to obtain a large settlement for him covering all of his medical bills and his motorcycle. Unfortunately, due to his lack of insurance, he was not able to receive "pain and suffering" compensation under California law, but The Dunnion Law Firm still was able to put a nice cash settlement in the client's pocket when no San Jose or Santa Cruz attorney wanted his case.
