A San Jose man hired the Dunnion Law Firm after a car crash caused by another driver who ran a red light, crumpling the driver’s side of his vehicle.
The Dunnion Law Firm successfully resolved the personal injury for a husband and wife who were traveling on Friant Road, en route to Table Mountain Casino. Unfortunately, another vehicle proceeding in the opposite direction, allegedly returning from an evening of gambling, crossed over the center line striking the plaintiffs head-on. The husband sustained a cut his nose; lacerations; and a left hip injury and settled his claim for $550,000. The wife, who suffered a broken right wrist, deep laceration to right hand between thumb and fore finger and lacerations from glass, settled her claim for $200,000 as a result of a Fresno County mediation.
A 39 year old man contacted The Dunnion Law Firm after being in an accident on May 26, 2008. The insurance carrier told the man he could not have been hurt in the accident because the amount of damage to the vehicle was less than $1,00.00. The repair estimate for the damage to the vehicle was $673.05.
The man had prior neck and back injuries, according to medical records. The insurance company argued the injuries sustained were not from the accident, but rather, a result of pre-existing conditions the man had at the time of the accident.
Suit was filed on March 10, 2009, followed by extensive discovery including numerous depositions of the doctors and other parties involved. The insurance company hired an accident reconstructionist to investigate the accident, a biomechanical expert to argue the forces involved in the collision could not have caused injury, and a doctor to testify the injuries could not been caused as a result of the accident. The insurance carrier continued to deny the claim and refused to make any offer of settlement.
The Dunnion Law Firm would not take no for an answer from the insurance carrier. As the matter was being prepared for trial, the insurance carrier finally came to realize that the plaintiff and The Dunnion Law Firm were going to fight to the end in order to force a full and fair settlement of the case. Fifty five days before trial was scheduled to begin, on February 16, 2010, and nearly two tars since the date of the accident, the carrier made its first offer. Within two weeks after that initial offer and after hours of negotiations with the defense attorney and the insurance adjuster, the matter, which had been initially denied settled for $155,000.00.
Our Client, a 40 year old mother of two and school district employee, contacted The Dunnion Law Firm after being in a head-on car accident on December 11, 2007. She broke her ankle in the collision and had to undergo three surgeries to her foot. Her medical bills for all of these surgeries came to over $70,000.00. Other law firms would have settled this woman’s case based on her medical records and medical bills for another $100,000, maybe another $200,000.
The Dunnion Law Firm goes further than other law firms in maximizing the settlement value of their client’s cases. For this school district worker, The Dunnion Law Firm hired several experts in the fields of orthopedic surgery, podiatry, vocational rehabilitation, and forensic economics. The insurance company was faced with going to trial against a plaintiff whose enormous, life-changing and permanent injuries and damages were proven by solid expert opinion. The Dunnion Law Firm was prepared to go to the mat at trial. Instead, the insurance company settled for more than 10 times the amount of the medical bills or $740,000.00.
The Dunnion Law Firm recently concluded a minor injury claim in mediation. Prior to hiring The Dunnion Law Firm, the defendant's insurance carrier refused to make any offer contending that claimant had not sustained any significant injury. The Dunnion Law Firm commenced aggressive litigation resulting in the defendant's insurance carrier abandoning its house counsel for a top rated Stockton trial attorney. The new attorney, after initially offering $60,000.00, agreed to mediation. Faced with overwhelming expert reports at the mediation, the defendant increased its offer by over $100,000.00 and a pre-trial settlement was achieved.

The Dunnion Law Firm successfully settled a bodily injury claim for a California man who was severely injured in Alaska while riding as a passenger in a vehicle driven by a friend. The driver of the vehicle left the roadway at a very high rate of speed and struck a utility pole and fire hydrant. The driver was subsequently arrested for driving under the influence of alcohol or drugs. Remarkably, our client stated to the investigating police officers, through an interpreter at the accident scene, that he was not injured in the single car accident.
Approximately 10 hours after the collision, the client suffered a debilitating massive stroke and was hospitalized in Alaska and Washington before finally being transferred to California for extensive rehabilitation. Through aggressive negotiation and expertise, the Dunnion Law Firm demanded and obtained double the policy limits plus attorney's fees from the at-fault drunk driver’s insurance company.

The Dunnion Law Firm represented a client who was a pedestrian struck by a hit-and-run driver while standing with friends in a parking lot. The collision knocked the victim violently to the ground. The driver of the hit-and-run car exited her vehicle to check on the victim, then suddenly got back in her vehicle, and sped away from the scene. No one at the scene was able to obtain the identity of the fleeing at fault driver. The Dunnion Law Firm commenced an immediate investigation and determined that the client's Uninsured Motorist (UM) coverage would be applicable in this case. The client’s insurance company initially outright denied the claim. A coverage battle ensued which the insurance carrier caused to drag on unnecessarily for months. During this time, the firm assisted the injury victim in obtaining the specialized medical attention she needed for her serious back and leg injuries. After aggressively prosecuting the case she eventually was able to settle her case without going to court for her policy limits of $100,000.00, plus $15,000.00 in medical coverage.
Six months after the hit-and-run accident, but prior to achieving it’s settlement, the same client was involved in a relatively minor car accident, which exacerbated the original back injury incurred in the hit-and-run accident. The defendant’s insurance company in the second accident knew of her first accident and took the position of blaming all of her injuries on that accident. They refused to make any type of offer and forced the firm to file a lawsuit against their driver. Litigation ensued until the case settled shortly before Trial at a private mediation obtaining a great six-figure settlement from the second accident insurance company. The client was so pleased with our results, she has referred her niece to the Dunnion Law Firm for her car accident case.

The Dunnion Law Firm represented a client who was involved in a major head-on accident and incurred serious injuries. The responsible party was killed in the accident. The client was confronted with delay tactics and given the runaround from the defendant’s insurance company for nearly a year before finally calling the Dunnion Law Firm as her life slumped into an emotional downward spiral. Her medical bills were over $360,000 and she had no car insurance of her own to provide for payment of any of her bills. She called and sought help from many other attorneys but all had rejected accepting her case. At first the defendant’s insurance company said they would not pay anything for her claim. Then, after further delays told her they would pay only her medical providers while she would get zero! She finally turned to The Dunnion Law Firm for help and they accepted her case.
The firm immediately filed a lawsuit against the other driver’s estate and filed a late claim with the Probate Court because the client had waited too long during the endless delays caused by the insurance company. During this entire time the insurance company never advised her of her rights or the fact that she would lose her right of recovery if certain time sensitive criteria were not met. With the aggressive involvement of the Dunnion Law Firm, the probate attorney and the defendant’s insurance company decided not to continue fighting and decided to settle for not only the $50,000.00 policy limits, but also paid the victim $30,000, a substantial portion of the deceased's estate. The firm then negotiated one medical lien from $200,000 owed by the client down to zero and another from over $160,000 to just $16,000. When all was said and done, the client ended up netting $25,000.00 in her pocket and all her medical bills were completely resolved.

The Dunnion Law Firm successfully settled a claim for a young soldier who was injured while home on leave from Iraq. The accident, caused by a fellow soldier driving a vehicle he was a passenger in, was a single car rollover crash that resulted in serious injuries to the young soldier. Through aggressive negotiation, The Dunnion Attorneys obtained the full policy limits from the defendants insurance company. Just as impressive, The firm was able to successfully negotiate a full waiver of the ARMY'S lien for medical services in the amount $275,516.65. It is nearly uneard of for the government to waive a lien of this type and size. As a result of these efforts the young soldier was recently discharged fron medical care and was able to leave the hospital with over $30,000.00 in his pocket, no medical bills owing and a life disability rating from the Army which would provide him many benefits for the rest of his life.

The Dunnion Law Firm successfully settled a claim for a young female client who was injured when her grandmother's car was struck exiting an apartment complex. There was no police report or other witnesses to the accident. The grandmother of the client settled her own claim and the insurance company offered the young female client's mother only $2000.00 for the injuries she sustained in the accident. When the minor reached the age of majority in 2008; her accident happened in 2005, she called The Dunnion Law Firm to see if they could help. The firm agreed to take on the case and confirmed that no formal release had been signed by the client or her guardian. The Dunnion attorneys negotiated with the insurance carrier and persuaded them to pay out the $50,000.00 Policy Limits as compensation for her injured shoulder despite the fact that the client had a pre existing orthopedic injury. The young client stated that she was was very happy that she called The DLF when she needed help as they made sure that she received the compensation she deserved and was not taken advantage of by the insurance company. At 8:45 a.m., the CHP responded to a call about the crash involving a silver Rav 4, a green Ford Mustang and a silver compact car.

JUNE 25, 2009 - SAN JOSE,CA - One victim involved in a vehicle collision in San Jose Wednesday night was pronounced dead at a hospital Thursday morning, a California Highway Patrol officer said.
CHP units responded to a collision on southbound state Highway 87 near Norman Mineta San Jose International Airport at around 10:10 p.m., CHP Officer Ralph Caggiano said. Two vehicles had apparently collided head on, causing one of them to burst into flames.
One female and a 20-year-old man were taken to a hospital with critical injuries, Caggiano said, and all three lanes of the roadway were blocked while emergency crews responded.
The female victim died from her injuries, Caggiano confirmed, and the man remained in critical condition with broken legs and hands.
A Sig-alert was issued at 10:23 p.m., and traffic had to be diverted off of Highway 87 at Skyport Drive. The right lane reopened to traffic at about 11:20 p.m., and all lanes were fully cleared just after midnight.
The crash was still being investigated this morning by the CHP, Caggiano said.
JUNE 23, 2009 - PASADENA -
An accident involving a Pasadena ARTS bus and a car on Tuesday morning has injured seven people. Paramedics were sent to Holly Street and Raymond Ave at about 10:30 a.m. The bus apparently jumped the curb during the collision. It knocked down a traffic signal before finally coming to a stop against a palm tree.

According to police, one of the vehicles ran a red light before the bus accident, but they are still investigating who was at fault here. Seven people sustained moderate injuries, including back and neck injuries. At least three other people sustained minor injuries, and were treated at the scene and released. The driver of the sedan was also evaluated at the scene before being released.
According to police, it was extremely fortunate that there were no injuries to pedestrians at the site. There usually tends to be heavy pedestrian traffic in the area as people walk in and out of the Senior Center. Investigations into the bus accident have already begun, and will take a while to complete.

JUNE 24, 2009 - AROMAS - The state transportation department announced last week it will be closing the southbound Hwy. 101 left-turn lane just after San Juan Road near the Red Barn by Monday, according to a press release.

The closure means drivers no longer can turn left at that point - typically to stop at the Red Barn or go northbound on Hwy. 101 - and are encouraged to turn around at the Highways 101-156 interchange. The press statement also notes that motorists also will be prohibited from making U-turns on southbound Hwy. 101 between San Juan Road and San Miguel Canyon Road.
Caltrans pointed out that the closure is intended to reduce the number of collisions along the busy corridor in northern Monterey County.
For the project, crews will restripe that section of Hwy. 101 and raise the curb to eliminate the southbound left-turn lane. Traffic signs prohibiting U-turns will be installed, and the work will be done in conjunction with a current paving job on Hwy. 101 at the San Juan Road intersection, according to the press release.

HOLLISTER
The California Highway Patrol has confirmed the identity of the AT&T truck driver killed in a rollover Friday on Highway 25 as Derek Silva of Hollister, according to a press release from the CHP.
Silva, 39, was driving a 2004 Ford utility truck at an unknown speed shortly before 7 p.m. north of Murphy Road when the vehicle left the eastern roadway edge for unknown reasons, according to the CHP. The vehicle then crossed the road's western edge and rolled over.
Silva was ejected, and paramedics pronounced him dead when they arrived, according to the CHP. He died of blunt force trama to the head, according to the press release.
The day began bright and hopeful, recalled Florentino Ramirez.
Ramirez, 25, an unemployed union carpenter from the Central Valley town of Patterson, was holding a carwash Saturday at the parking lot of a business south of downtown San Jose to raise money to bury his daughter, Florentina, who died June 16, after being born prematurely at 23 weeks.
His brothers and sisters, cousins and aunts were pitching in. By lunchtime, the carwash was under way. Lila McGraw, his younger sister, was standing just off the sidewalk, between two parked cars, holding a sign to passing motorists: "CAR WASH! Help family with infant death."
McGraw was laughing, entreating cars in English, then Spanish. "¡Lava su carro!"
"I was washing a car and everybody was joking around, being happy," Florentino Ramirez said. "Then, I heard tire screeching and a big crash."
"I looked up and I didn't see my sister where she was standing before," he said. "I looked hard and I only saw the sign she was holding on the ground."
In one loud, careening instant, McGraw lay dead on the asphalt. A stunned Ramirez tried to revive her. An aunt also tried.
San Jose police said a pickup truck traveling northbound on South First Street had swerved to the southbound lane to avoid rear-ending another vehicle that had stopped too quickly. The pickup struck McGraw. The initial investigation did not indicate use of alcohol by the driver, police said.
"Our entire family is in shock and we're all devastated," said Jo Anna Castillo, a cousin of McGraw's. "It's really, really hard to understand."
McGraw, a single mother of four boys ages 19 months, 4, 7 and 8, was saddened by the death of her brother's child, Castillo said. As a working mom — she worked at a new McDonald's on Monterey Road and Curtner Avenue — she also understood her brother's tough financial situation. She wanted to help raise money to pay for Florentina's burial.
McGraw, who grew up in San Jose, was looking forward to getting married next year. She was newly engaged, Castillo said, and was excited about having a new spouse to help raise her family. Friday afternoon, McGraw had gone into Filomena's Audio Waves, a car stereo business on South First Street, to talk with the owner, Filomena Amezquita. Her pitch was simple: She wanted to hold a carwash at the business parking lot because she was raising money to help her brother pay for a child's funeral. She offered to pay for the use of the parking lot and the water.
"I told her no problem. She didn't need to pay me,"Amezquita said. "I will help her."
Amezquita was working the day of the accident. She too, heard the crash and the screaming.
"I can't imagine losing two members of your family at once like this," she said. "It is heartbreaking for me, and I want to help them in anyway that I can."
Amezquita has put up a collection can at her business.
Meanwhile, McGraw's family is trying to deal with the numbing reality of two tragic deaths in less than a week.
"I'm in and out of my emotions right now," Ramirez said. "I'm trying to stay as strong as I can."

Two people killed in a weekend crash were young adults from San Jose.
The Santa Clara County Medical Examiner's Office on Monday identified Felipe Bergara, 20, and Marina Jennings, 19, as the two people killed Sunday night.
At about 5 p.m. Sunday an Infiniti was heading west on Yerba Buena Road, near Edenwood Drive, when the driver swerved to pass another vehicle, San Jose Police said. The Infiniti struck the curb in the right lane and rolled into a pole, police said.
Declared dead at the scene were the driver, Bergara, and Jennings, the right front passenger. Another male passenger was taken to a hospital with non-life threatening injuries and is in stable condition.
Speed may have been a factor, police said, but it was unclear so far if alcohol was a factor.
