Client hires the Dunnion Law Firm after having a motorcycle versus automobile accident.
Thomas J. Dunnion, founder of The Dunnion Law Firm of Monterey, California, has been retained to bring a lawsuit against Petrotek, Dale McAnally and Daniel Manrique, on behalf of Linda McIntyre, Esq. and her husband Michael McIntyre. Mrs. McIntyre was horrifically injured in a motor vehicle accident on September 28, 2009 on U.S. 101 in San Jose, California. Both Mr. and Mrs. McIntyre were traveling southbound on U. S. 101 north of Blossom Hill Road on their respective motorcycles. The defendants’ vehicle approached them from the northbound side of U.S. 101. A tire suddenly came off the defendants’ truck, traveled across the northbound lanes over a guardrail and into the southbound lanes. While Mr. McIntyre narrowly missed being struck, Mrs. McIntyre was unable to avoid the tire which collided with the front of her vehicle causing her to lose control and be ejected onto the roadway.
Most significantly, Mrs. McIntyre suffered an amputation to her left leg just below her thigh. Additionally, she suffered a severed artery at the time of the accident and ultimately was saved by the timely response of emergency personnel. Due to this accident, to date, she has had to undergo eight surgeries, a fracture to the right knee cap, displaced femur fractures and multiple other debilitating injuries, in addition to the loss of her limb.
Mrs. McIntyre, Esq. is currently employed by the Moss Landing Harbor District as the Harbor Master. Linda McIntyre has enjoyed riding her 2007 Harley motorcycle with her husband throughout the United States. Both Mr. and Mrs. McIntyre have suffered significant psychological, emotional and physical damages due to this matter.

JUNE 20, 2009 - HOLLISTER, CA - A 28-year-old Salinas man died in a motorcycle accident Saturday south of Cienega Road on Highway 25, according to a press release from the California Highway Patrol.
The man, whose name has not been released by the CHP, was southbound on a 2008 Suzuki at about 5:45 p.m. just south of Cienega Road. He was traveling at a "high rate of speed" and drove off the road. The man was ejected from the motorcycle, according to the CHP.
Medical responders pronounced him dead at the scene.
JUNE 23, 2009 - A motorcyclist was seriouslu injured by a hit-and-run driver on Interstate 680, authorities said. The collision occurred in the northbound lanes, south of Sunol Boulevard, around 6:35 p.m., according to the California Highway Patrol. The driver of a white 2004 BMW was driving approximately 100 mph and nearly collided with several vehicles, authorities said. The driver then began tailgating a 2005 Chevrolet sports utility vehicle before passing the SUV and slamming into the back of a 2007 Suzuki GSXR750. The impact caused the motorcyclist to be ejected and strike his head on the roadway, officials said. The rider was transported to Eden Medical Center in Castro Valley and treated for major injuries. The driver of the BMW reportedly continued northbound with a flat tire. The CHP is seeking the identity of the BMW driver.

JUNE 23, 2009 - An unidentified 40-year-old Gilroy male was killed Tuesday evening after colliding with an SUV and an unidentified pickup truck in a hit-and-run accident.

The accident happened around 5:50 p.m. on the corner of Watsonville Road and Redwood Retreat Road.
A silver 2005 Silver Toyota Tacoma TRD Sport SUV, driven by a 31-year-old Santa Cruz woman, was traveling southbound on Watsonville Road at an unknown rate of speed and attempted to turn right onto Redwood Retreat Road, according to the California Highway Patrol.
A silver and black 2008 Honda Interceptor motorcycle was stopped at the stop sign on Redwood Retreat Road with an unidentified white Nissan pickup behind the motorcycle at the stop sign. As the Tacoma made an unsafe turning movement, it failed to maintain its lead and crossed over the solid double yellow lines of eastbound Redwood Retreat Road, impacting the motorcycle head on and forcing the bike to crash into the front end of the pickup.
The driver of the motorcycle was pinned underneath the right side of the motorcycle and was pronounced dead at the scene by Santa Clara Count Fire Paramedics. The roadway of Watsonville Road and Redwood Retreat Road was partially obstructed for about two hours. Driving under the influence is not suspected, and no arrests have been made as of Wednesday morning.

PLEASANTON — A motorcyclist was seriously injured Monday evening after he was struck by a car on Interstate 680, the California Highway Patrol said. The driver of the car then sped away heading northbound.
The hit-and-run occurred about 6:35 p.m. on northbound I-680, south of Sunol Boulevard. CHP reported that the driver of a 2004 white BMW sedan was driving at upward of 100 mph and almost collided with several vehicles.
The driver began closely following a 2005 Chevrolet SUV before a curve in the highway and the motorcyclist was just ahead driving a 2007 Suzuki GSXR750. The motorcyclist's rear wheel was struck by the front of the BMW and the motorcylist was ejected onto the pavement and his head collided with the concrete roadway.
The driver of the SUV stopped to assist the motorcyclist, who was taken to Eden Medical Center in Castro Valley with major injuries.
The BMW driver reportedly drove away with a flat front tire. CHP is trying to determine the driver's identity.

An 18-year-old Martinez man was killed in a solo motorcycle accident on westbound Highway 4 west of Solano Avenue at 11:30 p.m. Monday, June 22, 2009 according to the California Highway Patrol.
Joseph Scalise was pronounced dead on the scene by paramedics after his motorcycle was found near the center divider, CHP officer Peter Van Eckhardt said Tuesday. The motorcycle had apparently crashed in the center lanes and started a fire, so Contra Costa firefighters also responded along with CHP, Van Eckhardt added.
CHP officials later determined that Scalise was ejected from the motorcycle due to high speed based on witness statements.
A two vehicle accident that happened around the same time in the same vicinity only caused property damage, according to Van Eckhardt. An autopsy will be performed today on Scalise.

California to pay biker $8.6 million in damages to paralyzed biker.
San Francisco, CA (JusticeNewsFlash.com)–As reported by the San Francisco Chronicle, a Monterey County jury ordered California’s Department of Transportation (DOT) to pay a biker paralyzed in a motorcycle crash in 2003 $8.6 million in compensation. According to the personal injury lawsuit, filed in a Monterey County Superior Court, the DOT failed to attempt to control the wild pig population from regularly crossing Highway 1 just south of the Carmel River which led to motorcyclist, Adam Rogers’, catastrophic injuries.
Rogers was riding down the California state highway in 2003 when his motorcycle struck the wild pigs causing him the major bike wreck which left him paralyzed and wheelchair confined for life. The 45 year-old former champion kickboxer and karate teacher will never walk again. The attorney for the plaintiff claimed California created the hazardous condition, was aware of the pigs were crossing the road to feed in a nearby environmental restoration project and did nothing to warn motorists, educate consumers or prevent the animals from crossing. After Rogers’ catastrophic motorcycle crash California officials posted a pig crossing sign and used hunters to control the problem.
