Boating Accidents and Injuries

Boating accident injuries include any injury that occurs on or because of a boat, ship, ferry, personal watercraft (jet ski, wave runner, etc.), or other watercraft. In the year 2000, there were nearly 11,000 vessels involved in 7,740 recreational boating accidents. These resulted in 791 fatalities and 4,355 injuries. Boating accidents are usually caused by one of three factors: an inexperienced boater, an intoxicated operator, or a boat malfunction. Types of recreational boating accidents may include capsizing, falling overboard, collisions with another vessel or structure, fire-sinking, flooding, and explosions. More than a third of both fatal and non-fatal boat accidents are alcohol related (DUI). It is estimated that boat operators with a blood alcohol content of .10 or higher are 10 times more likely to be injured or killed in a boating accident than sober operators. Other reasons for boating accidents include boat operator inexperience, recklessness/careless boat operation, operator inattention, operation at unsafe speeds, and water activities with no proper lookout. Slip-and-fall injuries due to wet surfaces are also common in recreational boating. Boating accidents can result in serious burn injuries, broken bones, back/neck/spine injuries, head injuries, and even wrongful deaths. Depending on the cause of your case, the owner of the boat, its driver, or its manufacturer may all be held liable for injuries and damages. The operator of a boat and its owner have a duty to exercise a reasonable degree of care in order to prevent injuries to passengers in the boat and swimmers or others in the water or boats around them. When careless boat drivers act foolishly and hurt people, the Dunnion Law Firm's lawyers aggressively pursue a lump-sum cash settlement to fully compensate the victims for the injuries damages they have incurred. This includes pain and suffering, medical bills, loss of past and future wages, and – in wrongful death cases – funeral costs. Though money alone can never fully compensate the victims for the tragedy that they endure, it can help cover expenses and allow the victims to heal to the greatest extent possible while moving on with their daily lives.

Swimming Pool Accidents and Injuries

According to the Center for Disease Control, there were over 3,300 deaths caused by drowning or submersion in 2000. This rate is particularly high for children under 16, which represent almost 25 percent of all drowning victims. About 350 children under 5 drown in pools each year. Drowning is the second leading cause of death for this age group after motor vehicle incidents. Adding to the tragedy are approximately 5,000 more children who experienced near-drowning emergencies. Many of those suffer permanent neurological disability. The vast majority of these accidents happen in backyard pools. Slip-and-fall injuries and drowning are the most common injuries that take place around the pool. Lawsuits based on these injuries typically fall under premises liability law. You may be able to file a product liability claim against a manufacturer or designer of a pool or spa or any substandard part used in its manufacture. For example, several faulty spa drain covers have been recalled in the past because of their responsibility for causing "body entrapment" resulting in serious injury and death. Both private and commercial swimming pool operators also have a responsibility to keep the pool safe, a job that includes keeping children safe in and around pools and hot tubs. When someone is hurt because a swimming pool was unsafely maintained, a lawsuit is often the answer to paying for medical bills and other expenses.
