Client was visiting her son, daughter-in-law and grandchildren. They were returning home when the defendant accelerated into the intersection, mistaking the turn signal for her signal. Defendant admitted to running the red light after realizing her mistake. The brunt of the impact was the passenger door where our client was sitting, striking her should with the door and pushing her forward so her knees struck the dash. Our client underwent hip replacement surgery before the accident. Imaging after the accident showed a femur fracture within the portion of the bone connecting to the replacement. The hip replacement had to be repeated. After months of unreturned phone calls, the adjuster disclosed an umbrella policy. Dunnion filed suit shortly after and rejected the insurance company’s first settlement offer of $500,000, ultimately settling the case for $1.25M.
