Decedent was crossing the street in a crosswalk. Defendant was not on the job but driving a work truck provided by his employer. Defendant disregarded multiple indications of approaching crosswalk and red light. Defendant did not stop, instead went through crosswalk at full speed hitting Decedent and knocking Decedent out of his shoes. Decedent pronounced dead at the scene. Defendant charged with misdemeanor vehicular manslaughter (PC192(c)(2)) on 2/15/24. Decedent died. Our clients are his 4 adult children. Decedent was very revered in his family as a leader and role model. He was a hard worker who was now retired. We quickly identified serious red flags in Defendant’s driving history that should have prevented the company from providing a vehicle with the Defendant, creating a risk of exposure to liability much larger than the insurance limits.
